Terms of Service

1. About SwimSteps

SwimSteps ("we," "us," or "our") is an online educational platform that provides guided swimming lesson content for parents and caregivers to use with young children. SwimSteps is operated by an individual based in the State of Florida, United States.

Our lessons are designed to supplement — not replace — qualified, in-person instruction from a certified swim professional. SwimSteps does not employ swim instructors, does not provide live coaching, and does not offer any professional or medical advice.

2. Eligibility and Account Registration

You must be at least 18 years old to create an account or make a purchase. By using SwimSteps, you represent and warrant that:

• You are 18 years of age or older;
• You have the legal capacity to enter into a binding agreement;
• All registration information you provide is accurate and complete;
• You will keep your account credentials confidential and notify us immediately of any unauthorized use.

SwimSteps reserves the right to suspend or terminate any account that violates these terms or that we reasonably believe poses a risk to other users or the platform.

3. License to Use the Service

Subject to your compliance with these Terms, SwimSteps grants you a limited, non-exclusive, non-transferable, revocable license to access and use the platform and any purchased lesson content for personal, non-commercial use only.

You agree not to:

• Copy, reproduce, distribute, or publicly display any lesson content;
• Screen-record, download, or extract video content;
• Resell or sublicense access to any part of the service;
• Reverse-engineer or attempt to extract source code or media assets;
• Use automated tools, bots, or scrapers to access the platform;
• Use the service for any unlawful purpose or in violation of applicable law.

4. Payments and Pricing

Lesson content is available for purchase through PayPal. All prices are listed in US Dollars (USD). By completing a purchase, you agree to PayPal's Terms of Service and Privacy Policy in addition to these Terms.

• Payment is due in full at the time of purchase.
• SwimSteps does not store your payment card information. All transactions are processed and secured by PayPal.
• Prices are subject to change at any time without notice. Changes do not affect purchases already completed.
• Access to purchased content is granted to your account only and is non-transferable.

5. Refund Policy — No Refunds on Digital Content

Because lesson content is delivered digitally and is immediately accessible upon purchase, we are unable to accept returns. This policy applies regardless of whether you have accessed or watched the content.

If you experience a technical issue that prevents access to content you have purchased, contact us at groppereran@gmail.com within 7 days of purchase and we will work in good faith to resolve the issue. Technical support is provided at our discretion and does not constitute a waiver of this no-refund policy.

Nothing in this policy limits any rights you may have under applicable consumer protection law.

6. Safety Disclaimer

By using SwimSteps, you acknowledge and agree that:

• You must ensure that a competent adult is physically present and actively supervising any child in or near water at all times.
• You must never leave a child unattended in or near any body of water, including pools, lakes, bathtubs, or any other aquatic environment.
• SwimSteps content must only be practiced in a safe, appropriate aquatic setting with proper supervision and safety equipment.
• Children with medical conditions, disabilities, or other health concerns must consult a licensed healthcare professional before participating in any swimming activities.
• SwimSteps makes no guarantee that following its lessons will result in any particular swimming outcome or level of water safety.

7. Liability Waiver and Assumption of Risk

By using SwimSteps, you voluntarily assume all risks associated with swimming and aquatic activities, including but not limited to the risk of drowning, near-drowning, physical injury, illness, and death.

You agree to release, waive, discharge, and covenant not to sue SwimSteps, its owner(s), operators, affiliates, successors, and assigns (collectively, "SwimSteps Parties") from any and all claims, demands, causes of action, damages, losses, costs, or expenses of any kind — whether based in contract, tort, negligence, strict liability, or any other legal theory — arising out of or in connection with:

• Your use of or reliance on any SwimSteps content;
• Any swimming or aquatic activity performed while using or after using SwimSteps;
• Any failure to follow safety guidelines or instructions;
• Any condition of the aquatic facility or environment where activities are conducted;
• Any act or omission of a third party, including swim facilities, instructors, or other participants.

If you are using SwimSteps on behalf of a minor child, you also release the SwimSteps Parties from any claims on behalf of that minor arising from the above circumstances.

8. Limitation of Liability

To the fullest extent permitted by applicable law, the SwimSteps Parties shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to loss of profits, loss of data, personal injury, or death, arising out of or in connection with your use of the service — even if we have been advised of the possibility of such damages.

In no event shall the total cumulative liability of SwimSteps to you for any claim arising out of or related to these Terms or the service exceed the greater of (a) the total amount you paid to SwimSteps in the twelve (12) months prior to the claim, or (b) US $10.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

9. Disclaimer of Warranties

The SwimSteps service and all content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

SwimSteps does not warrant that the service will be uninterrupted, error-free, or free of viruses or other harmful components, or that defects will be corrected.

10. Intellectual Property Rights

All content on SwimSteps — including but not limited to lesson videos, animations, written instructions, tips, graphics, logos, the SwimSteps name and brand, and the underlying software — is the exclusive intellectual property of SwimSteps and is protected by United States and international copyright, trademark, and other intellectual property laws.

Nothing in these Terms transfers any ownership rights to you. Your purchase grants a limited personal license to view content only, as described in Section 3.

11. Privacy

Your use of SwimSteps is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using SwimSteps, you consent to our collection and use of your information as described in the Privacy Policy.

12. Third-Party Services

SwimSteps uses third-party services including PayPal (payment processing) and Supabase (authentication and account management). Your interactions with these services are governed by their respective terms and privacy policies. SwimSteps is not responsible for the practices or content of any third-party service.

13. Changes to These Terms

We reserve the right to update or modify these Terms at any time. If we make material changes, we will update the "Last updated" date at the top of this page. Your continued use of SwimSteps after any changes constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

14. Termination

SwimSteps reserves the right to suspend or terminate your account and access to the service at any time, with or without cause, and with or without notice. If your account is terminated for violation of these Terms, you will not be entitled to any refund of amounts paid.

You may stop using the service at any time. Sections 5 (Refund Policy), 7 (Liability Waiver), 8 (Limitation of Liability), 10 (Intellectual Property), and 15 (Governing Law) survive termination.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law principles.

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of SwimSteps that cannot be resolved informally shall be submitted to binding arbitration administered under the rules of the American Arbitration Association (AAA), conducted in Florida in the English language. Judgment on the arbitration award may be entered in any court of competent jurisdiction.

You waive any right to participate in a class action lawsuit or class-wide arbitration against SwimSteps.

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

16. Entire Agreement

These Terms, together with the Privacy Policy and any additional terms presented at the time of purchase, constitute the entire agreement between you and SwimSteps with respect to the subject matter herein and supersede all prior or contemporaneous agreements, representations, and understandings.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
